Royalty-Free, Non-Exclusive End User License Agreement
for Licensor Art by Andy Nortnik, LLC/DBA Colorado Storefront For CD ROMs and Digital Downloads

Here are my terms, plain and simple folks:

You may add my clip art to and sell tangible PRODUCTS like T-shirts, mugs, etc. and you may also sell those products through Print-On-Demand store like CafePress, Zazzle, & Etsy. You may also add my clip art to electronic publications like e-books. In addition, you may also may use my clip art in print form such as publications and magazines as well as personal or nonprofit publications or social networking tools like blogs or forums.

NEW! EMBROIDERERS!
You may use my clip art as "templates" to create Digitized Embroidery Files and then resell those Digitized Files for profit, but please do not resell or offer for free the clip art in its original unaltered format.
You MAY NOT offer my clip art images for free or or sell them without my permission. If you are a clip art reseller and you wish to sell my clip art collection, or you wish for me to become a contributor at your website contact me at andy@andynortnik.com

It's NOT required, but PLEASE CONSIDER adding my copyright statement "Image ©AndyNortnik.com" or a link to my website http://www.andynortnik.com in conjunction with the image used or whenever possible. It's the only free marketing I get folks!
Please be aware that these terms are specific to images purchased through AndyNortnik.com ONLY and NOT through my reseller websites. Please abide by the terms posted at those sites instead. All images and collections are 100% Royalty-Free. Images may be used after the one-time payment is made. No further payments, fees or royalties are required. Once payment is made, an Instant Download Email will be sent to the email address that you indicated at checkout. If you do not receive the email within 2 hours, check your Spam folder and then if needed contact me at my email address below.

If you have some other use for my clip art not specified here, you would like me to customize one of my clip art images for you or you would like me to create a custom clip art image for you, email me at andy@andynortnik.com

The Rest of the Legal Mumbo Jumbo:

Refund & Exchange Policy for licenses, subscriptions & clip art: Refunds for clip art images or collections will be treated as exchanges only. I will be happy to exchange any image or collection with ONE new duplicate image or collection if you find that any image, file or the product in general is defective in any way. Also, it is the customer's responsibility to make sure the file formats indicated clearly on each Product Page are file formats that are compatible with the customer's computer, software and operating system BEFORE they purchase the collection. This includes but is not limited to decompressing the .zip "zipped" [compressed] folder files. For more information visit Winzip [PC/Windows users] or Stuffit Expander [Mac users].

Limitation of Liability and Indemnification: The Artist will not be liable for indirect, special or consequential damages, or any loss of revenue, profits or data, arising in connection with the download and/or use of the purchased product. You agree to defend, indemnify and hold the Artist, and each of their successors, licensees and assigns) free and harmless from any and all claims, liabilities, costs, losses, damages or expenses, including attorneys' fees and expenses, arising in connection with Your use of the Content or of any breach or alleged breach of any representation, warranty, or other promise made by You in this Agreement. The Licensee shall hold the Illustrator harmless from and against any loss, expense, or damage occasioned by any claim, demand, suit, or recovery against the Illustrator arising out of the use of the Image for the Licensed Products. I retain all copyrights to the images and the images may not be copyrighted or trademarked.

Modification: This Agreement constitutes the entire understanding between the parties and supersedes all previous agreements, promises, representations and negotiations, whether written or oral.
